could summarize what is before the puc with that? >> i can and we have city attorney here who is also familiar with this and perhaps could fill in some of the gaps for me. the code of conduct largely came out of the -- the law that created the code of conduct requirement came out of the experience that pg&e and marin energy had when marin energy launched its program so the code of conduct puts certain restrictions on both parties, the utility, in our case pg&e and on us as a cca. broadly speaking it prohibits either party from misleading customers. it requires that any expenditures that pg&e incurs to actively market against the program cannot be reimbursed by rate payers and shared by shareholders. it allows pg&e to answer questions and educate about their program and how it compares to our program. it requires both parties to work with the california public utilities commission public advisor's office to create a comparison document that would be made able by all parties on the two program offerings. so that gives you some of the key elements. >> and the code of conduct you sai

so we have to look at promise of our cities. san francisco bay area is a city that has great resources to meet the challenges of global climate change. this program, the cleanpower sf program is what we have. it's our greatest tool to assure we're doing our part around climate change around the world, and this little area of the world can actually make a huge difference, and that's what we have to decide how we're going to implement over the next few months, but the major work that we have actually accomplished by green lighting this program to move forward. i want to also emphasize that while we're actually implementing a program addressing our part with climate change and creating the clean power program in san francisco we're meeting a program that meets the needs of the city, not just around clean energy but employment and if we're successful in this program, and especially to the build out of the program that can happen when we have revenue coming in and many jobs can come with the build out and i am excited about that. there are neighbors in san francisco that are gr

this was considered a crime scene. just hours ago we contacted oakland police. >>> the city of oakland says it has a new crime fighting strategy and comes after the department avoided a federal takeover. the big name being brought in from los angeles and what he's planning to do to lower the city's crime rate. >>> chp still at the scene of a deadly crash. it all began with a traffic stop for speeding. christien kafton is near 580 with more. >> reporter: this deadly crash happened last night at about 11:20. as you said chp still on the scene conducting an investigation. if you look there in the distance you can seat silver bmw in the road there and in the distance there a black lincoln. that bmw smashed into that lincoln killing one of the persons inside that vehicle and then tried to run from the copping. california highway patrol tells us this started as a regular pull over. as a stop for speeding. the driver had been spotted speeding but the chp had the car pulled over at 90th. the officers got back into their patrol car and began following the bmw. they lost sight of that car momentarily. when

the identity of the young man shot and killed by police in a bay area city that rarely sees the type of violence. ktvu's jana katsuyama is live in walnut creek this evening to tell us what neighbors heard in the middle of the night. jana. >> reporter: that's right we have confirmed that the man who was shot and killed by police is anthony banta. he lives in that apartment come lek -- apartment complex right across the street. and his neighbors tell us he was a hairdresser that works just across the way. tonight we found the front window boarded up at apartment 60 where the man killed anthony banta lives. walnut creek police tells us they got a call from the apartment complex. the dispatcher could hear screaming in the background. police say when officers arrived about six minutes later banta was armed with a weapon inside the apartment. police say officers were forced to shoot banta. today neighbors say the gunshots woke them up. >> i heard something that sounded like seven to eight shots. >> i saw six or seven officers busting into the apartment with a lot of gunfire and running in

to the embarcadero for the fire works show. and there are other parties going on in the city. is a lot of people will not want to take their cars. bay area transit agencies are making it easier for them to leave their cars behind by offering free rides in some cases and extended service. starting with bart. bart you will still have to pay for your tickets but their trains will be running late tonight until 3:00 a.m. tuesday morning. but in order to avoid congestion, trains will not be stopping at all the stations. keep this in mind if you are riding the pepper bay point train it will stop at the embarcadero station. make sure you go to the right place to catch your ride home. muni is also extending service at the west portal and embarcadero stations. muni will run until 4:00 a.m. new years day. and fourth and king muni will run until 2:15 a.m.. muni will be free for riders starting from 8:00 p.m. until 6:00 a.m.. caltrain and samtrans will be giving free rides. the last train will leave at 2:15 a.m.. there are a lot of options, three free options for those looking to enjoy new years eve celebrat

from the storm. >>> we have a lot of trees going down and a lot of garage. >> reporter: city and county officials say the banks are not high enough to contain the water when there is heavy rain. last night's storm brought in the highest flow rate since the city first started measuring in 1930. >> it is not in good shape and rebuild the whole levee system and in this particular location they can build flood walls for up to 100 years of flood protection. >> reporter: they know a fix is needed and today they surveyed boils along the levee. it is so saturated along the bank that they are creating what is called a boil or hole and it is bubbling up creating mounds which is allowing water to go into the neighborhoods. >> every year they say they will fix but they never do. i don't know why. >> reporter: the water crested over near university avenue and woodland. this morning they were out surveying the creek and some owners -- some homeowners were out trying to protect their properties with sandbags. >> tomorrow we will probably have the same problem. >> back out here live, you can see city a

. haywood, union city, about to move into san ramone. solano scattered rain to report for this part of the bay area. bulk of the activity in the southern third of the bay area. you can see development out to the west. the yellows and reds, indicating the increase in the rainfall rates san jose to sunnyvale. out toward campbell, blossoo m hill road. increase in the rainfall and the possibility of hail with some thunderstorms. keep that in mind at least in the short term. as far as temperatures, its cool. mainly in the 40s to around 50. santa rosa in 40. haywood 48 and san jose around 46 degrees. forecast for today, cool showers this morning, we will hold on to the chance of showers right on in to the afternoon with temperatures only maxing out in the low to mid50s. yesterday's storm, that cold front, today we have the speckled clouds off shore. that's a signature of cold unstable air and that will sweep in to the area for today. we will hold onto the sun, passing clouds and heavier downpours. here is the forecast model, 10:00 showing you scattered rain showers, it's doing a good job

...that is where we begin our l with kron-4's j-r stone. who spoke with the city's mayor just a few minutes ago. j-r? >> reporter: i did. at the water levels are down. you can this see in the distance the and san franciscquito creek it was flowing and not quite like a great but more like a river. it was flowing into this river section that the working crews are trying to clean up. on the opposite side of that fence our homes. let me show you video. they have been busy out here for the last one hour working. the goal is to bring in more in san backs this evening. they wanted to secure this lobby. if they have more rain fall, or more in the coming days it will not be a problem for the homes. total, seven homes had mandatory evacuation's. and even the people in this neighborhood but there was a voluntary evacuation process. everybody with the exception of one home is back. that is good news. no injuries. we spoke with the mayor. short-term solutions, what the levy problems and also long term solutions in the works. >> right now given the conditions you do not want to move the soil around that much. y

the lights. >> a man was shot and killed last night in oakland. marketing the city's 126 homicide of the year. e >> they continue to look for is suspects that jumped into the creek last night. the started about 1238 and the town of ross. they pulled over a suspected drunken driver. when they were giving the sobriety test to the suspect he took off 01 feet and just over a fence. he it and jumped into this creek. they were able to have visual contact with their flashlights but they try to encourage him to get out of the water and that of merely they lost contact with him. they called other agencies to come out to help the mob.them out. >> they searched until about 430 this morning looking for any signs of the suspect. they could not find anything so that suspended the search. if they come back at daybreak to continue the search. so far they do not have any informational. this is where the command post was an obviously as this case and developing we will pass on any new information that we did. right now, we are waiting for search and rescue to come out here and start searching the creek again.
